The Federal Customs Service (FTS) of Russia has recorded cases of underestimation of the cost of customs clearance of cars imported from the countries of the Eurasian Economic Union (EAEU). This was reported to Gazeta in the press service of the department.
“There are problems with the underestimation of the cost of cars. Customs authorities are detecting cases of declaring passenger cars in the member states of the Eurasian Economic Union with signs of false information about their value, ”an official representative of the customs service told Gazeta.
The interlocutor at the Federal Customs Service clarified that the facts of price manipulation by the customs administrations of the countries where the declaration was carried out are revealed after the release of goods into circulation. Those who try to cheat will still be punished, since the declarant is responsible for the inaccuracy of the information.
“In such cases, all customs payments due will be collected from the declarant in full in the EAEU states where the customs clearance of cars was carried out”,

The car can be taken away
In customs, all risks follow the goods, so the principle of a bona fide purchaser for the buyer of a “problem” car does not work, explains the expert of the Customs Policy Council of the Chamber of Commerce and Industry Russian Federation, head of the group of customs regulation and international trade of the Group of Companies “B1” Wilhelmina Shavshina.
According to her, if the customs reveals that the goods were imported at a lower value, which led to non-payment of customs duties, then it can, with the help of administrative regulation, make claims against the current owner of the goods – starting from the requirement to pay the missing amount and seizure Title, up to the confiscation of goods, said Shavshina.
“In the most conservative scenario, the vehicle will be confiscated if an administrative prosecution is initiated under Art. 16.21 of the Code of Administrative Offenses of the Russian Federation (illegal use of goods, their acquisition, storage or transportation).
Illegal, because customs payments between the borders of the EAEU member states were not fully paid from them,” the interlocutor explained.
The sanction of the article for legal entities threatens with an administrative fine up to twice the value of the goods with its confiscation. The situation is complicated by the fact that it is very difficult for a buyer to determine the real primary cost of a car, Denis Migal, founder of the Fresh Auto automotive marketplace, believes.
“If the understatement was not critical, not at times, then it will be difficult to determine this, as well as to roll back such transactions.
In general, any parallel import is not very safe and transparent, because the car is bought from individuals, it is not clear how mutual settlements take place,” Migal emphasized.
“Kyrgyzstan is in the “gray zone” of the market
Car dealers and business participants interviewed by Gazeta said that the scheme with underestimation of the real cost of vehicles is often practiced not only in Kyrgyzstan , but also in Armenia, less often in other EAEU countries. According to the founder of RogovMobil, Dmitry Rogov (who specializes in turnkey delivery of cars from South Korea, Europe and Japan), unscrupulous sellers can triple the cost of a car in order to reduce customs duties. As a rule, it is most advantageous to do this in the case of importing expensive cars.

According to the interlocutor, there is a certain “grid” according to which cars are cleared through customs. If you declare a car, indicating the cost is much lower than this “grid”, then later there are risks associated with the annulment of the certificate of safety of the vehicle structure (SBKTS) and the vehicle passport (PTS).
The Association of Russian Automobile Dealers (ROAD) does not exclude that there are violations in this matter in Kyrgyzstan, in this country they are more loyal to the transparency of customs fees, the ROAD noted. True, all violations relate to the gray zone of the market – outbids, unofficial and other private sellers, the association assured.
